MEDICAL DISCLAIMER
DISCLAIMER: THIS WEBSITE DOES NOT PROVIDE MEDICAL ADVICE
The information, including but not limited to, text, graphics, images and other material contained on this website are for informational purposes only. No material on this site is intended to be a substitute for professional medical advice, diagnosis or treatment.
This website is operated by Takanui Limited, trading as Graze Guard (we, us and our). Takanui Limited is a private limited company registered in England and Wales under company number 16300372. Our registered office is Banks House, Ty Isa Road, Llandudno, Wales, LL30 2PL.
You can contact us at info@grazeguard.co.uk. Our registered office is not a customer returns address. Please contact us before sending anything back so that we can provide the correct return instructions.
These terms apply when you use grazeguard.co.uk and when you buy products from us through the website. They should be read with our Privacy Policy and any delivery, returns or product information shown on the website.
If you are buying wholly or mainly for personal use, you are a consumer. Nothing in these terms limits the rights given to consumers by law. If there is any conflict between these terms and a mandatory consumer right, that legal right will apply.
We currently sell and deliver website orders within the United Kingdom only. Because Graze Guard is an aerosol, delivery options and destinations may be restricted by carrier rules.
You must be at least 18 years old and legally capable of entering into a contract to place an order. If Graze Guard is bought for use by a child or young person, a parent, guardian or responsible adult should check the label and supervise its use.
We take reasonable care to describe and display our products accurately. Packaging, colour and appearance may vary slightly from photographs. Product information, ingredients, warnings and directions may change where required for safety, regulatory or manufacturing reasons. Always read and follow the label supplied with the product.
Graze Guard is a cosmetic pre-play skin barrier product. It is designed to help reduce the severity of friction-related grazes and turf burns; it does not guarantee that every graze or turf burn will be prevented. It is not a medical device and is not intended to diagnose, treat or heal an existing injury or wound.
1. When you submit an order, you are offering to buy the products in your basket under these terms.
2. We will normally send an email acknowledging that we have received your order. An acknowledgement is not acceptance of the order.
3. A binding contract is formed when we send confirmation that the order has been dispatched, unless we expressly accept it earlier.
4. We may decline or cancel an order before dispatch, for example if a product is unavailable, a price or description is materially incorrect, payment cannot be authorised, fraud is suspected, a delivery restriction applies or an order appears to be for unauthorised resale. If payment has already been taken, we will refund it.
Please check your order and contact details carefully before submitting them. Contact us promptly if you notice an error. We cannot promise that an order can be amended after it has entered fulfilment.
Prices are shown in pounds sterling and include VAT where applicable. Delivery charges, if any, are shown before you complete the order. We may change prices at any time, but this will not affect an order we have already accepted.
Payment must be made using one of the methods offered at checkout. Payments are processed securely by the relevant payment provider. We do not receive or store your full payment-card details. You confirm that you are authorised to use the payment method supplied.
If an obvious pricing error could reasonably have been recognised as a mistake, we may cancel the affected order and refund any amount paid.
A discount code or promotional offer is subject to any conditions shown with it. Unless stated otherwise, codes cannot be exchanged for cash, used after their expiry date or combined with another offer. We may refuse or withdraw a code that has been copied, transferred, misused or applied contrary to its conditions, without affecting orders we have already accepted lawfully.
We aim to dispatch orders within one to two working days. UK orders are normally sent using Royal Mail Tracked 48. Royal Mail generally aims to deliver Tracked 48 parcels within two to three working days after collection, but this is an estimated service rather than a guaranteed delivery date.
Any delivery estimate is an estimate unless we expressly agree a guaranteed date. If delivery is delayed by an event outside our reasonable control, we will contact you where practical and take reasonable steps to minimise the delay. Your statutory right to cancel for serious delay is not affected.
You are responsible for providing a complete and accurate delivery address and for ensuring that delivery can be made safely. If an order is returned because the address was incorrect, incomplete or delivery was not accepted, we may charge the reasonable cost of redelivery, but we will not impose charges that the law does not permit.
The products become your responsibility when they are delivered to you or to a person you identify to receive them. Ownership passes to you once we have received payment in full.
If you are a consumer, you normally have 14 days from the day after you, or a person nominated by you, receives the goods to tell us that you wish to cancel. You do not need to give a reason. If an order is delivered in separate parcels, the period runs from the day after the final parcel is received.
To cancel, email info@grazeguard.co.uk with your name, order number, the products you wish to return and a clear statement that you are cancelling. You may use the model cancellation form at the end of these terms, but you do not have to.
After telling us that you are cancelling, you must return the products within 14 days. Contact us first for return instructions. As Graze Guard is an aerosol, do not send a leaking, punctured or damaged can through the post, and follow the carrier and packaging instructions we provide.
You may inspect a product in the same way you reasonably could in a shop. We may reduce a refund to reflect loss in value caused by handling beyond what is necessary to establish the product's nature, characteristics and functioning. If goods are supplied with a hygiene or tamper seal, the cancellation right may not apply if the seal is broken and the goods are not suitable for return for health-protection or hygiene reasons. This exception does not affect your rights if the product is faulty, damaged, misdescribed or unsafe.
Unless the product is faulty, damaged or incorrect, you are responsible for the direct cost of returning it. We will refund the product price and the cost of our least expensive standard delivery option. We do not have to refund any additional amount paid for premium delivery.
We will make the refund without undue delay and no later than 14 days after we receive the returned goods or, if earlier, 14 days after you provide evidence that they have been sent back. We may withhold the refund until then. Refunds are made to the original payment method unless the law allows and you expressly agree otherwise.
We have a legal duty to supply products that are as described, of satisfactory quality and fit for any purpose made known to us. If a product arrives damaged, faulty or incorrect, contact info@grazeguard.co.uk as soon as reasonably possible with your order number, a description of the issue and photographs where available.
Asking you to contact us promptly helps us investigate carrier damage and resolve the issue, but it does not reduce your legal rights. Depending on the circumstances and the applicable law, you may be entitled to reject the product, receive a refund, or request a replacement. We will cover reasonable return costs where the product is faulty, damaged or incorrect.
· Use the product only for its intended cosmetic purpose and follow all directions and warnings on the can and packaging.
· Do not apply it to broken, irritated or infected skin.
· Skin sensitivity varies. If you have sensitive skin or known allergies, check the ingredients and test a small area first.
· Stop using the product and wash the area if irritation occurs. Seek appropriate medical advice if irritation persists or you are concerned.
· Observe all aerosol storage, heat, flame, ventilation and disposal warnings on the product.
We are not responsible for loss or damage caused by ignoring product instructions or warnings, using the product for an unintended purpose, modifying the product or using a product that has been visibly damaged, except where the law does not allow us to exclude responsibility.
The website and its text, graphics, photographs, videos, product names, trade marks, logos, design and other content are owned by or licensed to us and are protected by intellectual-property laws. Graze Guard is a trade mark of Takanui Limited.
You may view the website and print or save a reasonable extract for your personal, non-commercial use. You must not copy, republish, scrape, reproduce, modify, distribute, sell, license, frame or commercially exploit website content without our prior written permission, except where the law permits.
If you submit a review, photograph, video or other content to us, you confirm that you have the right to do so and that the content is lawful and accurate. Unless we agree otherwise, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for operating and promoting Graze Guard. We will handle personal data connected with submitted content in accordance with our Privacy Policy.
We try to keep the website accurate, secure and available, but we do not guarantee that it will always be uninterrupted or free from errors. We may suspend, change or withdraw any part of the website where reasonably necessary.
General educational content on the website is not medical advice and should not be relied on as a substitute for advice from a suitably qualified healthcare professional.
The website may link to third-party sites or services. Links are provided for convenience and do not mean that we control or endorse the third party. Their terms and privacy practices apply when you use their services.
We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for loss or damage that was not foreseeable, for losses caused by information or action outside our reasonable control, or for business losses suffered by a consumer.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, defective products under applicable product-liability law, or breach of your statutory consumer rights.
If you buy wholly or mainly for a trade, business, craft or profession, you are a business customer and statutory consumer cancellation rights do not apply. Unless we agree separate written terms, these terms apply to the order, but references to consumer rights apply only to consumers.
For business customers, to the fullest extent permitted by law, we exclude liability for loss of profit, sales, business, agreements, anticipated savings, goodwill, data and any indirect or consequential loss. Our total liability arising from a business order will not exceed the amount paid for that order, except for liability that cannot lawfully be excluded or limited.
We are not responsible for delay or failure caused by events outside our reasonable control, including carrier disruption, severe weather, fire, flood, industrial action, interruption of utilities or communications, government action, epidemic, pandemic or supply-chain disruption. This does not affect any right you may have to cancel where performance is materially delayed.
We use personal information as described in our Privacy Policy. You are responsible for ensuring that information supplied with an order is accurate and that you are authorised to provide it.
We may update these terms to reflect changes in law, our products, our services or how the website operates. The version in force when we accept your order will apply to that order. The date at the top shows when these terms were last updated.
We may transfer our rights and obligations under a contract to another organisation, but this will not reduce your rights. You may transfer your rights only with our written agreement, except where the law gives you a right to do so.
Each provision operates separately. If a court finds one provision unlawful or unenforceable, the remaining provisions continue in effect. If we delay enforcing a right, we may still enforce it later. No person other than you and us has a right to enforce the contract.
These terms and any contract between us are governed by the law of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you also retain any mandatory protections given by the law of your home jurisdiction.
Consumers may bring proceedings in the courts of the part of the United Kingdom in which they live. Business customers agree that the courts of England and Wales have exclusive jurisdiction.
Please contact us first so that we can try to resolve any concern directly.
